List 3 Exclusion Process

The United States Trade Representative (USTR) is working through the plethora of exclusion requests submitted for List 3. Several ALA members participated in the process and are still awaiting a final decision.

In the meantime, there have been some lighting-related exclusions granted. The followings HTS codes have been granted for exclusion by the USTR:

9405.99.4090 – Lamp shades of fabric over metal frame

9405.20.6010 – Electric household floor-standing lamps, of base metal other than brass, each measuring 1.22 m or more but not over 2.59 m in height, with an E26 socket

9405.20.6010 – Electric household floor-standing lamps, of base metal other than brass, each measuring 77 cm or more but not over 232 cm in height with light-emitting diode (LED) lamp as light source

9405.20.6010 – Electric household table or desk lamps, of base metal other than brass, each measuring 25 cm or more but not over 92 cm in height with an E26 socket

9405.20.6010 – Electric household table or desk lamps, of base metal other than brass, each measuring 38 cm or more but not over 87 cm in height, with light-emitting diode (LED) lamp as light source and featuring an AC outlet, a charging pad and USB port designed for the charging of electronic devices

9405.20.8010 – Electric household table or desk lamps, of wood, each measuring 25 cm or more but not over 80 cm in height, with an E26 socket

9405.20.8010 – Electric household floor-standing lamps, of wood, each measuring 115 cm or more but not over 210 cm in height, with an E26 socket

Exclusions granted by USTR are not for the sole purpose of the entity that submitted the request. Meaning ALA members can use these granted exclusions if importing products under the listed HTS codes and associated product descriptions. Manufacturers should work closely with vendors to ensure that all import-related paperwork or electronic transmissions use the granted HTS codes with matching product descriptions. If a product is imported under a granted HTS code but has a different product description, then that product will incur the additional tariff.

List 3 granted exclusions are good from Sept. 24, 2019 to Aug. 2, 2020.
